1. Introduction and Acceptance of Terms

  • Agreement: These Terms and Conditions ("T&C") govern the use of the website www.caratcult.com (the "Website"), owned and operated by Ananta Impex, under the brand CaratCult.
  • Acceptance: By accessing or using any part of the Website or our Services, you ("User," "Customer," or "you") agree to be bound by these T&C, along with the Privacy Policy and all other guidelines/policies displayed on the Website. If you do not agree to these terms, you must not use or access this Website.

  • Eligibility: By agreeing to these T&C, you represent that you are at least the age of majority in your state or province of residence.

  • Governing Law and Jurisdiction: These T&C shall be governed by and construed in accordance with the laws of India. Any dispute or difference arising out of or in connection with these T&C shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
  • Account Security: You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

 

 

2. Products, Pricing, and Orders


  • Product Information and Appearance: We make every effort to display products accurately. However, the actual appearance, including size/colors, may differ from what appears on your screen due to monitor settings or photography technique or the inherent nature of diamonds and gemstones. We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
  • Product Discontinuation and Limits: We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
  • Certification: All diamond jewelry sold on the Website will be certified by recognized international and national laboratories like IGI (International Gemological Institute), SGL, SDI and will carry the BIS (Bureau of Indian Standards) Hallmark, as applicable.
  • Pricing and Taxes: Prices listed on the Website are inclusive of all applicable taxes, including Goods and Services Tax (GST). Prices, discounts, and promotions are subject to change without notice.
  • Final Weight and Price Adjustment:
    • The carat weight and metal weight displayed are approximate and indicative. The final finished product's weight may vary a little leading to difference in pricing which will be adjusted by either refunding / charging as explained below.

    • Refund (If Weight is Less): If the final weight is less than the weight ordered, the equivalent excess amount paid by the Customer will be refunded.

      • Example (Refund): If a ring is priced based on a 4.5 gram gold weight, and the final manufactured ring weighs 4.4 grams, the cost difference for the 0.1 gram will be refunded to the Customer.

    • Charge (If Weight is More): If the final weight is more than the weight ordered, the equivalent differential amount will be charged to the Customer. Product will only proceed to shipping after the successful realization of this differential payment.

      • Example (Charge): If a pendant is priced based on a 3.0 gram gold weight, and the final manufactured pendant weighs 3.1 grams, the cost difference for the 0.1 gram must be paid by the Customer before the item is shipped.
    • Similarly fluctuation of gold/silver rates may also lead to the similar thing. We do our best to keep the prices updated using current gold/siver rates but it may be outdated at any given point of time. The price of the metal on the day of purchase will be considered and may lead to refund / charging of the differential amount from the customer similar in similar fashion as explained above.
  • Order Acceptance: An order is deemed confirmed only upon the successful realization of the full payment. CaratCult reserves the right to accept or decline your order for any reason at its discretion.
  • Right to Cancel by CaratCult: CaratCult reserves the right to cancel any order at any time without assigning any reason. In the event of cancellation by CaratCult, the full amount paid will be refunded to the original payment source within 7-10 working days.
  • Errors, Inaccuracies, and Omissions: We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

 

3. Payment, Shipping, and Delivery


  • Payment Methods: We accept online payment methods including Credit Cards, Debit Cards, Net Banking, and Unified Payments Interface (UPI). We DO NOT offer Cash on Delivery (COD) for any orders.

  • Accuracy of Billing and Payment Information: You agree to provide current, complete and accurate purchase, payment and account information. You represent and warrant that the credit card information you provide is true, correct, and complete, and you are duly authorized to use such credit card for the purchase.

  • Shipping Area: We only ship products to addresses within India. See out detailed shipping policy here.

  • Shipping and Delivery Delays: Estimated delivery times are indicative and may vary. We are not liable for shipping and delivery delays.

  • Risk and Title: All shipments are fully insured by CaratCult until they are delivered to the confirmed recipient at the shipping address. The risk and title of the product pass to you upon successful delivery.

 

4. Returns, Refunds, Resizing, Buyback and Purchases

 

  • Return Window: Customers may initiate a return request for a refund within seven (7) calendar days from the date of delivery. Find more details about eligibility and the process in our detailed return policy.
  • Resizing Policy: Certain items are eligible for resizing, please read the details in resizing policy.
                           
  • Buyback Policy: We offer a 90 day period buyback upto 70% value, all details are mentioned in buyback policy.

  • Personal Use: Your purchases are for your own personal or household use and not for commercial resale or export.

 

5. Intellectual Property and Use of Services


  • Ownership: The brand name CaratCult, the domain name www.caratcult.com, logos, designs, text, graphics, and all other content on the Website are the exclusive intellectual property of CaratCult.
  • Permitted Use: These Terms permit you to use the Services for your personal, non-commercial use only.

  • Restrictions: You must not reproduce, distribute, modify, or exploit any content from the Website without the prior written consent of CaratCult.

  • Prohibited Uses: You may not access or use the Services for any unlawful or malicious purpose, to violate any laws, to infringe upon or violate our intellectual property rights or those of others, or to upload or transmit viruses or malicious code.

 

6. Termination, Liability, and Amendments


  • Termination: We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

  • Disclaimer of Warranties: The Services and all products offered are provided "AS IS" and "AS AVAILABLE" for your use, without any representation, warranties or conditions of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

  • Limitation of Liability: To the fullest extent provided by law, CaratCult, our partners, officers, employees, or licensors (including those of Shopify and its affiliates), shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages.

  • Amendments: We reserve the right to amend these T&C at any time without prior notice. Your continued use of the Website after any such changes constitutes your acceptance of the new T&C.

 

7. Other Clauses


  • Relationship with Shopify: CaratCult is powered by Shopify. However, any sales and purchases you make in our Store are made directly with CaratCult. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with CaratCult.

  • Indemnification: You agree to indemnify, defend and hold harmless CaratCult and Shopify, and our respective affiliates, from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

  • Severability: In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

  • Waiver; Entire Agreement: The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us constitutes the entire agreement and understanding between you and us.

  • Headings: The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
